1. PARTIES & ACCEPTANCE OF TERMS OF USE
The terms of use detailed herein, and any other rules posted on our website www.islandpalmdesignerdresshire.co.uk (“Website”) (collectively “T&C”) govern the relationship between you (the “Customer”) and Fiona Stephen trading as Island Palm Designer Dress Hire (“Island Palm”) in respect of the hire and sale of products (the “Service”).
By using the Service, you are agreeing to be bound by the T&C and any modifications that may be made to T&C from time to time.
2. MODIFICATIONS
Island Palm reserves the right to change the T&C at any time and in any manner at its discretion and any such modifications shall be posted on the Website and effective thereon.
3. ELIGIBILITY OF THE CUSTOMER
The Customer must be:
- Legally capable of entering binding contracts, and
- At least eighteen years old.
4. HIRE PERIOD
The cost to hire any item (generically a “Dress”) shall be stated on the website (“Hire Cost”) and is for a three-day period to include the day of collection and the day of return by the Customer of the Dress (“Hire Period”).
The Customer shall be informed of the full retail price of the Dress at the point of hire.
5. LATE RETURNS
If the Customer returns the Dress outside the Hire Period unless otherwise agreed between Island Palm and the Customer, the Customer will be charged a late fee of £8.00 per day for the first five days the Hire Period is exceeded.
If the Dress has not been returned after five days of the Hire Period, the Customer shall pay the full retail price of the Dress.
6. DEPOSIT
The Customer will authorise charge of £40 to a credit card or pay cash or bank transfer as a deposit, fully refundable on return of the Dress in compliance with the T&C.
7. PAYMENT
The Customer must provide accurate, complete, and current credit card information authorized for use by the Customer.
The Customer by presenting a credit card at commencement of the Hire Period, authorizes Island Palm to charge the Hire Cost and any credit card fees and any other charges to include but not limited to charges pursuant to clause 5 and 8 incurred in connection with the Service.
If Island Palm does not receive payment from the Customer’s credit card provider or if the credit card expires or is rejected, the Customer shall pay all amounts due upon demand.
The Customer is responsible for all fees charged to their credit card and agrees to notify Island Palm of any billing problems or discrepancies within 90 days of appearing on the Customer’s credit card statement. If the Customer does not notify Island Palm within 90 days, the Customer agrees to waive the right to dispute such problems of discrepancies.
8. DAMAGE and ALTERATION
If a Dress is returned in a damaged or dirty or stained condition that exceeds normal wear and tear, as determined by Island Palm in its sole discretion, the Customer agrees that Island Palm may also in its sole discretion charge the Customer for the cost of repair and retains the right to charge the full retail price of the Dress if ruined beyond repair.
The Customer must not alter or dry clean or make any additions to the Dress or in any other manner interfere with the Dress. If the Customer does so, Island Palm reserves the right to charge the repair cost or full retail price of the Dress.
The Customer is responsible for loss or damage to the Dress such as theft, fire, severe stains, and any other causes. If the Dress sustains any such loss or damage, the Customer shall pay the full retail price.
The Customer must notify Island Palm of any damage to the Dress that occurs during Hire Period.
9. JURISDICTION
The parties irrevocably agree that the courts of UK shall have exclusive jurisdiction to hear and decide any suit, action, or proceedings and/or settle any disputes which may arise out of or in connection with the T&C or its formation or validity and the laws of UK shall apply.
10. SEVERABILITY
In the event any provision or part of the T&C is found to be invalid or unenforceable, only that particular provision or part so found and not the entire T&C will be inoperative.
